Terms of Service

1. Agreeing to these terms

These terms are an agreement between you and [Company name and mailing address] ("Hoof&Pawz", "we", "us") for the Hoof&Pawz mobile app and the website at hoofandpawz.com (together, the "Service"). By creating an account or using the Service, you agree to these terms and to our Privacy Policy. If you do not agree, please do not use the Service.

2. Who can use it

You must be at least 13 years old, or older if your country requires, and able to form a binding contract. If you use the Service for an organization, such as a kennel, stable or farm, you confirm you can accept these terms for it.

3. Your account

You need an account to use the app. Give us accurate information, keep your password private, and tell us right away if you think someone else has accessed your account. You are responsible for what happens under your account.

4. Not veterinary advice

Hoof&Pawz is a record-keeping and reminder tool. It does not provide veterinary, medical or professional advice. Always follow your veterinarian's instructions for diagnosis, medication and care. If you think an animal is ill or injured, contact a veterinarian right away. Information in the app comes from you and others you share with. We do not check it for accuracy.

5. Reminders and notifications

Reminders and notifications depend on your phone, its settings, your network connection and third-party services, so they may be delayed, missed or not delivered. Do not rely on them as your only way of tracking time-critical care. You are responsible for your animals' care.

6. Plans, payments and renewals

• Prices are in US dollars. They may vary by country and may include taxes, and the price shown in the app store at purchase is the one that applies. We may change prices with notice, and a change applies from your next renewal.
• Paid plans are billed through your Apple or Google account, and renew automatically each month until you cancel. To cancel, use your Apple or Google subscription settings at least 24 hours before the renewal date. Deleting the app or your Hoof&Pawz account does not cancel a subscription.
• Refunds are handled by Apple or Google under their policies, not by us.
• Some features, such as sitter sharing and pet transfers, may be marked as coming soon and may not yet be available.
• If you move to a lower plan, we never delete your pets or records. You may be unable to add more until you are within that plan's limits.

7. Pet transfers

When pet transfers are available, you may transfer a pet's profile and records to another person. A fee of $19.99 applies to each transfer on the Free and Plus plans (Platinum includes free transfers), and the person who starts the transfer chooses who pays. After a transfer is accepted, the pet and its records belong to the new owner's account, and the previous owner no longer has access. Transfers record ownership of information in the app only. They do not transfer legal ownership of an animal.

8. Household sharing

You can invite people to your household and choose which of your pets to share. Members can view shared pets, records and schedules, and can mark doses as done, but cannot edit or delete them. You are responsible for who you invite. Only share information you are entitled to share, and respect the privacy of the people you share with.

9. Your content

You own the information you put in the Service, such as pet records, notes and photos. You give us a limited license to store, process, copy and display it only as needed to run the Service for you and the people you share it with. You promise that you have the right to add it and that it does not break the law or anyone's rights.

10. Acceptable use

You agree not to:

• break the law or use the Service to harm animals or people;
• access another person's account or data without permission;
• interfere with or disrupt the Service, or try to bypass its security, limits or ad display;
• copy, reverse engineer or resell the Service, except where the law allows;
• upload malware, or use automated tools to scrape or overload the Service;
• use the Service to send spam or unwanted invitations.

11. Ads and third-party services

The free plan shows ads from third parties. We are not responsible for the ads or the products and services they promote. The Service relies on third parties such as Apple, Google and our hosting and technology providers. Their terms apply to your use of their services, and we are not responsible for them.

12. Our property

The Service, including the Hoof&Pawz name, logo, design and software, belongs to us or our licensors and is protected by law. We give you a personal, limited, non-transferable license to use the app on your own devices in line with these terms.

13. Apple and Google

If you get the app from the Apple App Store or Google Play, these terms are between you and us, not Apple or Google. Apple and Google have no obligation to provide support or maintenance for the app. If the app fails to meet a legal warranty, you can notify the store to refund the purchase price where applicable, and we are responsible for any other claims. Apple and Google, and their subsidiaries, are third-party beneficiaries of these terms and may enforce them against you. You confirm that you are not in a country under a US government embargo and not on a US government list of prohibited parties.

14. Ending your use

You can stop using the Service and delete your account at any time from Account in the app. We may suspend or end your access if you break these terms or misuse the Service, or if we stop offering it. If we end your access for a reason other than your breach, we will give you reasonable notice and a chance to export or copy your information where we can.

15. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent the law allows, we make no promises or warranties of any kind, express or implied, including that the Service will be uninterrupted, error free, secure, or accurate, or fit for a particular purpose. We do not guarantee that data will never be lost, so keep your own copies of important records.

16. Limit of liability

To the fullest extent the law allows, Hoof&Pawz and its owners, employees and suppliers are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data, or harm to any animal, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim and $50.

Some places do not allow these limits, so they may not apply to you. Nothing in these terms limits liability that cannot legally be limited.

17. Changes to the Service and these terms

We may change or discontinue features, and we may update these terms. For significant changes, we will give notice in the app or by email. If you keep using the Service after a change takes effect, you accept the new terms. If you do not agree, you can delete your account.

18. Governing law and disputes

These terms are governed by the laws of the State of Arizona, USA, without regard to conflict of law rules. Courts in Arizona have exclusive jurisdiction over disputes, except where your local consumer law gives you the right to bring a claim in your own country. Please email support@hoofandpawz.com first so we can try to resolve any problem informally.

19. General

These terms, with the Privacy Policy, are the whole agreement between you and us about the Service. If a part is found unenforceable, the rest stays in force. If we do not enforce a term, we have not given up the right to do so later. You may not transfer your rights under these terms without our written consent.
